In accordance with Law No. 6698 on the Protection of Personal Data (KVKK), your personal data shared with ishqhal.com may be processed—fully or partially, automatically or non-automatically, provided that it is part of any data recording system. This includes obtaining, recording, storing, modifying, reordering, and any other action taken with respect to the data. Under KVKK, all such actions are defined as “processing of personal data.”

2. Purposes and Legal Grounds for Processing Your Personal Data
Your personal data may be processed for the following purposes:

  • To fulfill the requirements of the services we provide to our customers in accordance with contractual and technological necessities and to improve the offered products and services;
  • To provide information to prosecutors, courts, and relevant public officials upon request and in accordance with legislation, in matters concerning public safety and legal disputes;
  • To offer our members a wide range of opportunities or to share such opportunities with individuals or institutions within the legal framework;
  • To analyze advertising preferences.

All data processing activities will be conducted in accordance with Law No. 6698 and relevant secondary regulations.

3. Disclosure Regarding Third Parties or Organizations to Whom Your Personal Data May Be Transferred
For the purposes outlined above, the personal data you share with ISHQHAL may be transferred to:

  • Our principal shareholders and shareholders,
  • Advertisers,
  • Our direct or indirect domestic and international affiliates,
  • Member companies using the ishqhal.com infrastructure,
  • Individuals or organizations related to the services provided,
  • Organizations and service providers we cooperate with, receive services from, or partner with as data processors, including domestic/international entities and other third parties.

4. How Your Personal Data Is Collected
Your personal data may be collected through:

  • Forms on the ISHQHAL.com website and mobile applications that request information such as name, surname, address, phone number, and business or private email addresses;
  • Preferences on pages accessed via username and password;
  • IP logs of transactions, cookie data collected by the browser, browsing time and details, and location data;
  • Business cards, resumes (CVs), proposals, and other means shared by individuals who contact ishqhal.com for purposes such as establishing a commercial relationship, applying for a job, or submitting proposals—whether shared physically or virtually, in person or remotely, verbally, in writing, or electronically;
  • Indirect sources such as websites, blogs, competitions, surveys, games, campaigns, and similar (micro) websites, as well as public databases and openly shared data and profiles on social media platforms (Facebook, Twitter, Google, Instagram, Snapchat, etc.).

5. Personal Data Obtained Before KVKK Came Into Effect
As ISHQHAL.com was not operational prior to the effective date of KVKK (April 7, 2016), no personal data was stored before this date.

6. Transfer of Your Personal Data
Your personal data, collected by any of the methods described above, may be processed in Turkey or abroad and transferred for storage or processing outside of Turkey—provided it remains within the scope of KVKK and for purposes aligned with contractual requirements. Data may be transferred to service providers located in countries accredited by the Personal Data Protection Board as providing adequate protection.

Your personal data may be shared with:

  • Our business partners with whom we cooperate and/or receive services for the provision and promotion of products and services,
  • Authorized authorities who may need to identify your location in emergencies,
  • Regulatory and supervisory bodies, courts, enforcement offices, and other public institutions authorized to request such data,
  • Legal entities that have a commercial relationship with moohtia.com and possess your phone number,
  • Other entities when deemed necessary.

7. Storage and Protection of Personal Data
ISHQHAL.com is obligated to take all necessary technical and physical security measures—such as hashing, encryption, transaction logging, and access control systems—to protect your personal data from unlawful processing or unauthorized access, in accordance with Article 12 of the KVKK.

In the event that your personal data is obtained illegally by others, the situation will be immediately reported in writing to the Personal Data Protection Board, in compliance with legal regulations.

8. Accuracy and Updating of Personal Data
According to Article 4 of the KVKK, ISHQHAL.com is obligated to keep your personal data accurate and up to date. In this context, to ensure moohtia.com can fulfill its obligations under applicable legislation, our members must share accurate and up-to-date data or update it via the website or mobile application.

9. Rights of the Personal Data Subject Under KVKK
Article 11 of the KVKK, which came into effect on October 7, 2016, grants the Personal Data Subject the following rights:

By applying to ISHQHAL.com (as the data controller), the personal data subject has the right to:

  • Learn whether their personal data is being processed,
  • Request information if their personal data has been processed,
  • Learn the purpose of processing and whether it is being used in accordance with that purpose,
  • Know the third parties to whom their personal data has been transferred, domestically or abroad,
  • Request the correction of incomplete or incorrect data,
  • Request the deletion or destruction of data within the framework of Article 7 of the KVKK,
  • Request that such correction, deletion, or destruction be notified to third parties to whom the data was transferred,
  • Object to results derived against them through automated analysis of personal data,
  • Request compensation if they suffer damages due to unlawful data processing.

10. Contact and Application Method
The Data Controller Representative to be appointed by ISHQHAL.com will be announced in the Data Controllers Registry and published on the same web page as this policy, once the legal infrastructure is in place.

Personal Data Subjects may direct their questions, opinions, or requests to the email address: official@ishqhal.com.

ISHQHAL will try to respond to submitted requests—positively or negatively—within 30 days, providing written or digital responses, with justification. In principle, requests are free of charge. However, if a process incurs a cost, ISHQHAL reserves the right to charge a fee. These fees will be based on the tariff determined by the Personal Data Protection Board in accordance with Article 13 of the Personal Data Protection Law.

By sharing your personal data via our website, applications, or other communication channels, you acknowledge and declare, through clear and informed consent as defined under KVKK, that:

  • You accept the terms related to data processing, methods of processing, data transfer, sale, and other relevant issues in our Personal Data Policy;
  • You consent to the use of data shared with the social media application ishqhal.com across its website, apps, and social media channels;
  • You agree to receive notifications and suggestions;
  • You approve that such data may be shared with third parties for commercial purposes, provided it benefits members;
  • And that you will first apply to ISHQHAL before exercising your legal rights.
